Gómez-Acebo & Pombo advised Incus Capital on the structuring and formation of a consortium with Reolum for the design, financing and development of a 49.9 MW biomass power plant on the former site of the La Robla Thermal Power Plant (León). The consortium formed by both companies received 46.1 MW in the third energy auction called by the Ministry of Ecological Transition and Demographic Challenge (MITECO) held at the end of October 2022 at a price of 106.25 euros/MWh.
Incus Capital is a private equity and investment advisory and management firm founded in 2012 that advises investment funds on real estate and debt opportunities in southern Europe. The company manages assets worth more than €2 billion. Reolum is a company specialised in the integrated development of renewable energy projects, mainly wind, solar and biomass, founded and led by a team with more than 20 years of experience, which has developed more than 7GW in different technologies.
The GA_P team was led by Borja Carvajal, partner in Public and Regulatory Law, and was formed by: Carolina Orri, Javier Reyna and Marta del Toro, Commercial associates, Fernando Trigo, Manuel Ramos and Álvaro Obregón, Public and Regulatory Law associates and Oliver Padilla and John Galilea, Tax associates.

Prohibition of arbitration in the single energy market
The Agreement on the interpretation and application of the Energy Charter Treaty gives the force and effect of law to the case law of the Court of Justice of the European Union, according to which Article 26 of the Energy Charter Treaty does not and could not apply as a legal basis for intra-EU arbitration proceedings as a mechanism for the settlement of disputes between a contracting State and an investor of another contracting State.
